Terms of Service

1. Acceptance of Terms

By creating a SmartySales account or using any part of the platform, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Service Description

SmartySales is a SaaS platform that (1) automatically classifies and labels incoming corporate email through user-defined rules and LLM classification, (2) helps you discover prospective clients via external data providers and enriches them with decision-maker contacts via LLM web search, and (3) generates and sends personalized outreach using customizable templates — automatically or manually from a client's card, with support for file attachments.

3. Account Registration

Registration requires a corporate email address (public-domain emails such as gmail.com, yahoo.com, mail.ru are not allowed). You must provide accurate information and keep your credentials secure.

4. Subscription and Billing

  • Each corporate domain is eligible for one 7-day free trial (the "Trial" plan, 10 units of each quota).
  • Paid plans — "Standard" (2,900 ₽/month), "Professional" (13,900 ₽/month) and "Corporate" (46,900 ₽/month) — include monthly quotas for inbound email processing, outbound sending, and new client enrichment; exact limits are listed on the Plans page.
  • Monthly quotas reset on the day of the month matching your subscription start (00:00 Moscow time, UTC+3). For example, a subscription started on the 5th renews on the 5th of the next month.
  • The client quota is charged only for clients whose enrichment has actually been attempted (READY or ERROR status) — adding a company to the search queue does not consume quota until the background worker processes it.
  • If a subscription expires, your account becomes read-only — you can view existing data but cannot process new email, run searches, or send outbound messages.
  • Automatic renewal (recurring payments): if you tick "Enable automatic subscription renewal" at checkout, you authorise SmartySales and YooKassa (LLC NBCO YuMoney) to automatically charge the bank card used at checkout for the same amount and the same period (monthly or yearly) before the current period ends. The card number is stored only by YooKassa; SmartySales receives a token that allows charges to that card and nothing else.
  • You may disable automatic renewal at any time on the "Subscription" page; the change takes effect immediately and applies to the next billing period. Already-paid periods are not refunded automatically. Cancelling the subscription also disables automatic renewal.
  • If a recurring charge fails (insufficient funds, expired card, bank decline), automatic renewal is switched off and the platform notifies the company administrator by email; access stays available until the end of the already-paid period.
  • Payments and recurring charges are processed by YooKassa (LLC NBCO YuMoney, OGRN 1127711000031) under its own public offer. Fiscal receipts are issued through the self-employed tax registry (lknpd.nalog.ru) and can be downloaded from the "Subscription" page.

5. Acceptable Use

  • You must comply with applicable anti-spam and email-marketing laws in jurisdictions you send to — both for automated outreach and for messages sent manually from a client's card.
  • You may not abuse LLM quotas, attempt to extract our prompts, attach malicious files to templates, or scrape our user interface.
  • You may not attempt to access other tenants' data (including any attempt to bypass the cross-tenant cache), reverse engineer the platform, or interfere with operations.

6. Intellectual Property

The SmartySales platform, including its source code, branding, and prompts, belongs to the SmartySales team. Your tenant data — clients, templates, emails — remains yours.

7. Limitation of Liability

The service is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform.

8. Termination

We may suspend or terminate accounts that violate these terms. You may cancel your subscription at any time from the dashboard.

9. Changes to These Terms

We may update these terms; significant changes will be announced to your registered email at least 30 days before they take effect.

10. Governing Law

These terms are governed by the laws of the Russian Federation. Disputes are resolved in courts at the location of the SmartySales operator.
